  • Legal Research & E-Discovery: AI tools can rapidly survey vast numbers of documents, retrieve relevant case law, and identify key information far faster than human counterparts.4 Technology-assisted review (TAR), including predictive coding, allows lawyers to review enormous data volumes with minimal errors, define the universe of relevant data in litigation, and assess risks far earlier in a case’s lifecycle.2
  • Contract Analysis & Drafting: AI excels at parsing semi-structured documents like contracts. These tools can identify non-standard clauses, flag risks by comparing terms against market standards, and draft initial versions of agreements, significantly reducing the time spent on tedious manual drafting.6 For tasks like due diligence in mergers and acquisitions, AI can automate the review of thousands of contracts with at least 98% accuracy, a task that would take a human over 80 hours and be prone to a 10-20% error rate.10

In stark contrast, professional-grade tools like Thomson Reuters CoCounsel, Lexis+ AI, and Westlaw Edge are purpose-built for the legal profession.10 These platforms are specifically trained on curated, authoritative legal data, such as the content libraries of Westlaw and Practical Law.10 Crucially, they often incorporate advanced technological safeguards, most notably Retrieval-Augmented Generation (RAG), which forces the AI to ground its outputs in reliable, verifiable sources rather than inventing information.10 This distinction is not merely a technical detail; it represents the first and most important line of defense against the risks of inaccuracy and professional malpractice. The AI achieved 94% accuracy in just 26 seconds. The human lawyers, by contrast, achieved 85% accuracy and took 92 minutes to complete the same task.6 This result starkly illustrates AI’s strength in rapidly and consistently applying predefined rules to structured data.

The underlying mechanism that allows an AI to summarize a document is the same probabilistic process that can lead it to invent a legal case.14 Therefore, the very reliability of AI on low-stakes tasks paradoxically increases the risk that a lawyer will fail to verify a less obvious, high-stakes error. The danger is not that the AI is consistently wrong, but that it is

mostly right, making its occasional but critical failures much harder to spot and potentially more catastrophic when they occur.

Despite its impressive performance in certain areas, AI is far from infallible. Its accuracy degrades significantly when tasks move from structured data analysis to areas requiring nuance, ambiguity, and true legal reasoning.

In stark contrast, 8% of the legal research results generated by the general-purpose AI ChatGPT were “hallucinated non-existent cases”.19

  • Training Data: The adage “garbage in, garbage out” is paramount in the world of AI. The accuracy, reliability, and potential biases of an AI model are fundamentally determined by the quality, currency, and scope of the data on which it was trained.6 Models trained on curated, authoritative, and constantly updated legal sources will inherently and significantly outperform those trained on the chaotic and unvetted information of the open internet.12
  • Task Specificity: AI performs with much greater accuracy on closed-domain tasks (e.g., “Extract the change of control clause from these 50 agreements”) than on open-domain tasks (e.g., “Draft a persuasive argument to defeat this motion for summary judgment”).6 The more constrained and clearly defined the task, the more reliable the output.
  • Human Supervision: Ultimately, accuracy is not an inherent property of the AI tool alone but of the integrated human-machine system. The level, diligence, and expertise of the human supervision applied to the AI’s output are the most critical determinants of the final work product’s reliability and defensibility.6

The significant variance in performance across different tools and tasks means that law firms can no longer rely on vendor marketing claims. This reality is giving rise to a new and critical governance function: the ability to design and execute internal benchmarks. Industry initiatives like the Vals AI report and the LITIG AI Benchmarking project reflect a growing demand for standardized evaluation methodologies.16 For an individual firm, the duty of competence now extends to the technological due diligence process. This requires creating internal pilot programs to test prospective AI tools on the firm’s own specific documents and use cases

before firm-wide deployment. This process ensures that the chosen tool is fit for its intended purpose and that its specific limitations and failure modes are understood and accounted for in the firm’s workflows and training protocols.21

 

Section 3: The Specter of Hallucination: An Anatomy of AI-Generated Falsehoods

 

3.1. Defining AI Hallucination

 

The most dangerous failure mode of modern generative AI is the phenomenon of “hallucination.” In the context of AI, a hallucination is a response that contains false, misleading, or entirely fabricated information that is presented as fact.18 It is more accurately described as a confabulation—the construction of a plausible but untrue statement—rather than a perceptual error as the term implies in human psychology.18

This phenomenon is a direct byproduct of the fundamental architecture of Large Language Models (LLMs). These models are not databases retrieving verified facts; they are incredibly sophisticated prediction engines. Their core function is to predict the next most probable word (or “token”) in a sequence, based on the statistical patterns they have learned from their vast training data.14 This process incentivizes the model to “give a guess” and generate fluent, coherent-sounding text, even when it lacks the underlying factual information to answer a query accurately.20 The result is content that can appear entirely authentic, complete with proper names and plausible-sounding citations, but which is, in reality, completely fictional.23

 

3.2. The Landmark Case: Mata v. Avianca, Inc.

 

The case of Mata v. Avianca, Inc., a 2023 decision from the U.S. District Court for the Southern District of New York, was the seminal event that brought the abstract risk of AI hallucination into the stark reality of legal practice.24

  • Facts: The case began as a routine personal injury claim against an airline. In response to a motion to dismiss based on the statute of limitations, the plaintiff’s attorneys filed a brief that relied heavily on legal research conducted using ChatGPT. The brief cited numerous non-existent judicial opinions, including fictional cases such as Varghese v. China Southern Airlines, Shaboon v. Egypt Air, and Miller v. United Airlines.25 When challenged by opposing counsel and the court, one of the attorneys, Steven Schwartz, compounded the error. He submitted an affidavit stating that he had asked ChatGPT to confirm the cases’ legitimacy, and the AI had “assured” him they were real and could be found in reputable legal databases. He even attached purported excerpts from the fake opinions, which were also generated by the AI.25
  • Judicial Ruling: Judge P. Kevin Castel found the attorneys’ conduct inexcusable and held that they had acted in “subjective bad faith”.25 He imposed a $5,000 fine and other sanctions, including requiring the attorneys to notify every judge whose name had been falsely invoked in the fabricated opinions.26 In a widely cited opinion, Judge Castel detailed the “gibberish” nature of the AI’s legal analysis and articulated the many harms that flow from such submissions: they waste the time and money of the court and the opposing party, they deprive the client of potentially valid legal arguments, and they promote deep cynicism about the legal profession and the American judicial system.24
  • Impact: The Mata case serves as a stark and universally cited warning that misunderstanding technology is not a defense for a failure of professional responsibility. The court made it unequivocally clear that the duty to verify the accuracy of legal filings remains squarely and non-delegably with the attorney, regardless of the tools used to produce them.7

 

3.3. A Pattern of Misconduct: Subsequent Sanctions and Judicial Reprimands

 

The events in Mata were not an isolated incident but rather the first high-profile example of what has become a distressingly familiar pattern. A growing database of court cases reveals a consistent stream of lawyers and pro se litigants submitting AI-generated falsehoods to courts across the United States and around the world.27

The judicial response to these incidents appears to be hardening over time. While the Mata opinion took pains to explain the nature of AI and its pitfalls, more recent cases show judges exhibiting less patience and imposing more punitive sanctions. The defense of “naivete” or “a naïve understanding of the technology” is wearing thin, as the legal profession has been inundated with articles, ethics opinions, and mandatory CLE courses on the topic.28 Courts are now operating under the assumption that lawyers have been put on notice. Consequently, future violations are more likely to be treated not as innocent mistakes but as willful blindness or a reckless disregard for fundamental professional duties, leading to harsher consequences.

This is evidenced by a series of increasingly severe sanctions:

  • In California, an appeals court issued a record $10,000 fine against a lawyer who submitted a brief in which “nearly all of the legal quotations…are fabricated”.29
  • In the U.S. District Court for the Central District of California, attorneys from two major international law firms were ordered to jointly pay $31,100 in the defendant’s legal fees after submitting a brief containing numerous hallucinated citations. The Special Master in the case found their collective conduct was “tantamount to bad faith” and chastised them for failing to check their research even after being alerted to the errors.28
  • In a products liability case in Wyoming, attorneys from the prominent plaintiffs’ firm Morgan & Morgan were sanctioned for violating Federal Rule of Civil Procedure 11. They had submitted motions citing eight non-existent cases generated by the firm’s own in-house AI platform. The judge emphasized that the duty to conduct a reasonable inquiry into the law is “nondelegable,” and that “blind reliance on another attorney” (or, by extension, an AI) is a violation of that duty.30

Across these and other cases, courts have consistently rejected a litany of excuses, including blaming paralegals, facing tight deadlines, suffering from health issues, or being unaware of the technology’s limitations.29 The message from the judiciary is clear: the buck stops with the licensed attorney who signs the filing.

The database of hallucination cases shows a high prevalence of unrepresented parties using AI to generate legal filings.27 Courts traditionally grant a degree of liberal construction to pleadings from pro se litigants. However, AI allows these individuals to generate sophisticated-looking but nonsensical briefs, creating a “computer-generated morass” that blurs the line between a good faith assertion of a claim and an abuse of the judicial process.27 This forces courts and opposing parties to expend significant resources debunking fabricated arguments and citations, clogging dockets and creating procedural unfairness.24 This emerging issue may eventually lead courts to develop new local rules or standing orders that specifically address AI use by unrepresented parties, potentially creating a necessary exception to the traditional liberal-construction rule.27

4.2. Mapping the ABA Model Rules to AI Use

 

The core tenets of legal ethics apply directly to the use of generative AI, providing a robust framework for responsible practice.

  • Rule 1.1 (Competence): This is the central pillar of a lawyer’s ethical duty in the age of AI. The duty of competence requires lawyers to “keep abreast of changes in the law and its practice, including the benefits and risks associated with relevant technology”.7 This now unequivocally includes developing a reasonable understanding of how AI tools work, their specific capabilities and, most importantly, their limitations—particularly the inherent risk of hallucinations.31 Competence demands that lawyers know how to properly prompt these tools and, critically, how to verify their outputs. Over-reliance on AI to the detriment of independent, critical legal analysis is a clear violation of this duty.32 The standard of care has evolved from a passive “awareness” of technology to a requirement of active “proficiency” in vetting, using, and supervising these powerful tools.
  • Rules 5.1 & 5.3 (Supervisory Responsibilities): These rules require law firm partners and supervising attorneys to make reasonable efforts to ensure that the firm has effective policies in place and that the conduct of non-lawyers—a category that now includes AI systems—is compatible with the professional obligations of the lawyer.7 A lawyer cannot simply delegate a research or drafting task to an AI and accept the output without diligent review. The firm must implement review protocols and training to ensure that AI-assisted work meets professional standards.33
  • Rule 1.6 (Confidentiality): Inputting confidential client information into public or insecure AI tools poses a catastrophic risk to client confidentiality. The duty of confidentiality requires lawyers to take reasonable steps to prevent the inadvertent or unauthorized disclosure of client information. This involves meticulously vetting AI vendors for their data security protocols, reading and understanding their terms of service regarding how input data is used (especially whether it is used for training the model), and anonymizing client data whenever possible by removing names, addresses, and other identifying details before inputting prompts.32
  • Rule 3.3 (Candor Toward the Tribunal): Submitting a court filing that contains hallucinated case law is a direct and egregious violation of the duty not to knowingly make a false statement of fact or law to a court.7 The
    Mata, Wadsworth, and other sanctions cases are textbook examples of this rule being breached.24 Lawyers must meticulously verify all AI-generated citations and legal propositions before including them in any submission to a tribunal.32
  • Rule 1.4 (Communication): The duty to keep a client reasonably informed may require lawyers to disclose their significant use of AI in the client’s representation. This is particularly true if the use of AI impacts the case strategy, the cost of the representation, or the security of the client’s confidential information.7 Transparency builds trust and is a core component of allowing the client to make informed decisions about their matter.31
  • Rule 1.5 (Fees): Ethical billing practices in the context of AI are clear: a lawyer must not charge hourly fees for time saved by using AI. Billing must reflect the actual human effort expended. This includes time spent crafting and refining prompts, reviewing and critically editing the AI’s output, and integrating it into the final work product. Fee agreements should be transparent with clients about how any costs associated with the use of AI platforms will be handled.32

In July 2024, the ABA’s Standing Committee on Ethics and Professional Responsibility issued a formal opinion specifically addressing the use of generative AI, clarifying how the Model Rules apply.25 Similarly, state bars, such as the State Bar of California, have published detailed practical guidance for lawyers. This guidance provides specific “dos and don’ts” regarding confidentiality, competence, supervision, and billing, serving as a clear articulation of the evolving standard of care that all lawyers are expected to meet.32

The use of AI also introduces a new and subtle layer of potential conflicts of interest and bias. AI models can be trained on data that contains societal biases, which can then be replicated in their outputs. Using a biased AI to screen potential clients or employees, for example, could lead to discriminatory outcomes, implicating Rule 8.4.1’s prohibition on discrimination.3 Furthermore, the AI supply chain itself presents novel challenges. If a law firm uses a vendor’s AI that was trained on data from a competitor or an adverse party, it could create complex, undisclosed conflicts. If a vendor’s terms of service allow it to use a firm’s input data to improve its model, that firm is inadvertently contributing its proprietary work product and potentially confidential client information to a tool that will be used by other, potentially adverse, parties.32 This necessitates a new level of due diligence that goes beyond simple security reviews to a deeper inquiry into data provenance, training methodologies, and data-sharing policies to mitigate these emerging ethical risks.

The most effective technical defense against AI hallucination is the adoption of tools built with a technology called Retrieval-Augmented Generation (RAG).

  • What is RAG? RAG is a technique that fundamentally changes how an LLM generates answers. Instead of relying solely on the vast but unverified patterns in its internal training data, a RAG-enabled system is first directed to retrieve relevant information from a specific, authoritative knowledge base. This could be a curated database of case law and statutes (like Westlaw), a firm’s internal document management system, or a specific set of discovery documents.37 The AI then uses this retrieved, trusted information to “ground” its response, constructing its answer based on the provided source material.15
  • Why RAG is the Key Technical Defense: RAG directly mitigates the risk of hallucination by forcing the AI to base its answers on verifiable sources rather than on probabilistic invention.
