However, its protections are narrowly defined, applying only to “covered entities” (such as healthcare providers, health plans, and healthcare clearinghouses) and their “business associates”.78 Most direct-to-consumer mental health apps that a user downloads from an app store do not fall into these categories.77 This creates a significant regulatory gap, leaving a vast amount of sensitive mental health data—including mood logs, journal entries, and the full transcripts of therapeutic conversations—legally unprotected by federal health privacy law.

In the absence of HIPAA’s constraints, many app developers operate under the same data practices as conventional tech companies. In a high-profile case, the Federal Trade Commission (FTC) fined the mental health platform BetterHelp for disclosing users’ emails, IP addresses, and sensitive health questionnaire responses to third-party platforms like Meta (Facebook), Snapchat, and Pinterest for advertising purposes, despite explicit promises of confidentiality to its users.76 Another platform, Talkspace, was reported to have mined anonymized transcripts of user therapy sessions for business insights and to train AI models.76

Apps that position themselves as general “wellness” tools—for example, by promoting mindfulness, stress reduction, or mood tracking without making specific claims about treating a diagnosable disorder like GAD or MDD—are typically not regulated by the FDA.84 Consequently, many app developers carefully craft their marketing language to avoid making explicit medical claims, thereby sidestepping FDA scrutiny, even as consumers use their products for clear therapeutic purposes. As a result, of the approximately 20,000 mental health apps available in app stores, only a handful have received FDA clearance or approval.84

They eliminate the need for appointments and travel, providing support in moments of immediate need, such as during a late-night anxiety attack.3 This continuous availability is a significant departure from the appointment-based model of traditional therapy.
  • Scalability and Cost-Effectiveness: A single AI platform can serve millions of users simultaneously, a level of scalability impossible for human providers. This allows for the delivery of mental health support at a fraction of the cost of traditional therapy, with many apps offering free or low-cost subscription models.62 This makes them a viable first step for individuals who cannot afford or access conventional care.
  • Anonymity and Reduced Stigma: Interacting with an AI can feel less intimidating than speaking to a human therapist. The perceived anonymity and non-judgmental nature of the chatbot can lower the barrier to seeking help and encourage users to be more candid and honest, particularly when discussing deeply personal or stigmatized issues.10
